Terms of service

1. General, Customers, Language

1.1 All offers, sales contracts, deliveries and services made on the basis of any orders by our customers (each, a „Customer“) through our online shop (the „Online Shop“) shall be governed by these general terms and conditions of sale (the „General Terms and Conditions“). Owner of the Online-Shop is:

1.2 Standard business conditions of the Customer do not apply, regardless of whether or not we expressly object to them in a particular case.

1.3 Our contracts with the Customer shall be made exclusively in the German or English language, in each case depending on whether the Customer makes the relevant purchase on our English language or on our German language website.

1.4 We save the contract wording, which the Costumer can view at any time in the customer log-in area, along with all your previous orders if he had created a client account at the Online-Shop.

 

2. Conclusion of Contract

2.1 Our offerings in the Online Shop are non-binding. The Customer can choose items from the Online Shop´s assortment of goods and can collect them with the button “Add Item to Basket” in a so-called “Shopping Cart”. The Costumer can delete goods in the virtual shopping cart by pressing the button “X” or closing the browser. After having placed the selected goods in the virtual basket and passed through the ordering process, and by clicking the button “Buy now” finalizing the order process, the Costumer submits a legally binding offer of contract with regard to the goods contained in the shopping cart. Without undue delay upon receipt of the order, we will send to the Customer by e-mail a confirmation of receipt, which shall not constitute an acceptance of the order. The order shall be deemed to be accepted by us either upon subsequent (e-mail) acceptance of the order within five working days or by dispatching the product. The sales contract with the Customer shall not become effective until our acceptance.

2.2 If the Costumer chooses Paypal as payment method the contract takes effect by the payment order to Paypal.

 

3. Right of Revocation

Any Customer who is a natural person who enters into a legal transaction for a purpose that is outside his trade, business or profession (Costumer as defined by Sec. 13 German Civil Code (BGB)) shall be entitled to revoke the offer and return the product in accordance with the cancellation and return policy as separately made available to the Customer on our website during the ordering process.

 

4. Dispatch of the Product, Shipment

4.1 We deliver to designated countries in Europe. The delivery is made with various parcel service providers as a standard package The delivery time is about 3-9 working days. Any differing delivery times are indicated on the appropriate product page.

4.2 If advanced payment has been agreed the delivery begins when the payment is received. This is the working day after the costumer has initiated a payment transaction.

4.3 Delivery and shipping costs

Unless otherwise agreed the delivery is carried out from our warehouse to the delivery address provided while placing the order.

4.4 Delivery type, shipping costs and delivery time

Our goal is to dispatch your order upon receipt of payment or the next business day at the latest. During high-volume sale periods, it may take up to 3 business days to dispatch your order. Jimmy’s Secret is not responsible for any delays caused by destination customs clearance processes, severe weather or other unforeseen circumstances. Estimated delivery times are to be used only as an approximated guideline, and commence from the date of dispatch.

4.5 National delivery 

All shipments by parcel service can generally not be delivered to PO box addresses or packing stations. The terms and conditions of the parcel service apply in addition and can be read online.

4.6 International delivery

4.6.1 Delivery within the European Union

Single Songs and people Divertion S.L. currently delivers to the following countries within the European Union: Austria, Belgium, France, Germany, the Netherlands and Spain.

4.6.2 Delivery outside the European Union not available.

4.8 Insurance

All goods you order are insured against damage or theft from the pick-up at our premises until the delivery to the address provided. Single Songs and People Divertion S.L. covers all insurance costs.

Please note that all deliveries must be signed for. In case you give explicit instructions to our shipping partner to deliver your shipment without signature requirement, Single Songs and People Divertion S.L. will not be liable for any loss or damage.

4.9 Tracking your order

As soon as your order is passed to our shipping partner, you will receive a separate email. In this email you will find a tracking number for your order, which you can use to track your order online.

 

5 Returns and exchanges 

5.1 Basic procedure 

If you are not satisfied with a product or would like to exchange a size, this is possible at any time within 14 days. To return your product, please fill out the RETURN APPLICATION. You can find this on www.jimmys-secret.com under RETURNS. Now choose whether you want to return or exchange the item. Finally, send it to us by post or e-mail and you will receive the RAN (Return Authorization Number) or the exchange number. Note the number(s) on the return form enclosed with your shipment and enclose it with your return. Please note that all ordered goods are equipped with various labels and are delivered in this way. If the goods have been used, worn, washed, damaged or the labels are no longer attached, Single Songs and People Divertion S.L. is not obliged to take back or exchange the goods. If shoes show signs of wear or if the shoes are not returned in the original designer box, acceptance of the item will not be accepted. We therefore advise you to try on shoes only on a carpet. Please return the shoes in their original packaging. The return shipment will be made with the shipping company through which the package was delivered.

 

6. Prices and Payment, Payment methods

6.1 Our prices include statutory VAT, but are net of shipping costs. Any customs du-ties and similar public charges shall be borne by the Customer.

6.2 The Costumer can see the actual shipping costs on our Online-Shop and the virtual shopping cart.

 

7. Methods of payment

The Costumer can use the following methods of payments: advanced payment, invoice, Paypal. After the selection of payment-option “PayPal” you are rerouted on the SSL coded homepage of PayPal.

 

8. Retention of Title

We retain legal title to any product supplied by us until the purchase price (including VAT and shipping costs) for such product has been fully paid.

 

9. Warranty

We provide a warranty in accordance with the statutory requirements.

 

10. data protection 

10.1 For the order processing we work together with different companies, which are responsible for example for the payment processing and logistics. We make sure that our partners also comply with the data protection regulations. 
10.2 Depending on the selected payment method, the payment processing of orders may be carried out by using a service provider. If payment is made via PayPal, your personal data must be transmitted to PayPal so that your order can be processed. 

 

11. Online Dispute Resolution

The EU Commission maintains under the following link a platform for online dispute resolution: http://ec.europa.eu/consumers/odr

This platform serves a central point of out-of-court agreement between Costumers and entrepreneurs raising from online sale contracts.

 

12. Battery Disposal

In conjunction with the sale of batteries or hardware which contains batteries, the vendor is obliged to point out the following to the Customer: The Customer is, as an end user, legally obligated to return used batteries. Used batteries can be re-turned free of charge to the vendor or to designated return points (e.g. communal return points or at the retailer´s) or they can be returned also by mail to the vendor. The vendor reimburses in any case the postage paid for the return of the used battery. The signs pictured on the batteries have the following meaning:

13. Competent Courts and Applicable Law

13.1 If the Customer is a corporation, limited liability company or commercial partner-ship or otherwise operates a commercial business (Kaufmann within the meaning of Sec. 1 (1) of the German Commercial Code) or is a legal entity or special fund organized under public law, the courts in Bielefeld shall have exclusive jurisdiction in respect of all disputes arising out of or in connection with the relevant contract. In all other cases, we or the Customer may file suit before any court of competent jurisdiction under applicable law.

13.2 Any contracts entered into between us and the Customer shall be governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory conflict of laws provisions.
